Gangbuk Police Station Chief Chae Soo-chang has claimed that police command’s excessive push for results-based competition brought about a system that led to the acts of torture and cruelty at Yangcheon Police Station. As only arrest numbers and points are stressed through this system, contempt for both the people’s human rights and safety and adherence to legal procedure have been commonplace within the police organization. Chae also warned that if this current focus on results is not corrected, it would lead to more acts of cruelty.
The harm caused by the excessive focus on arrest numbers has been pointed out internally within the police sector and externally for some time. When arrest points are decided by crime and these points are reflected in personnel decisions, police become negligent in work that yields few points, such as crime prevention like patrols and public services. It is very common for police to show no desire for criminal investigations in which the point total is low or is difficult to resolve, and to focus only on easy investigations. The fact that these crimes, which could be handled with just a warning, end up with accusations against innocent victims or outrageous incidents like the torture at Yangcheon Police Station is also because of this. Police are turning the people into target to boost arrest numbers.
We must determine where this custom began. During his press conference, Chae called on Seoul Metropolitan Police Agency (SMPA) Commissioner Cho Hyun-oh to take responsibility for the deeply flawed organizational culture and resign. He said he caused the excessive competition for results while reflecting the existing criminal results system in personnel decisions. The roots of this prioritization of results only and efficiency, however, run much deeper than this.
The reason the police organization considers human rights and democratic procedures lightly is because they have experienced reward for doing so rather facing rebuke. In fact, since the start of the Lee Myung-bak administration, most of the police officials who violated the lives and human rights of the people by treating them as rioters and engaging in verbal and physical violence and unreasonable crackdowns were either transferred with no personnel measures taken or kept their current positions. Police ignored over 60 percent of the National Human Rights Commission warnings last year.
It is not excessive to say that President Lee Myung-bak’s statement that he would overlook minor mistakes made by police in executing their duties and the prioritization of results led to these events.
The government and police must not ignore what took place at Yangcheon Police Station as a rare deviation. The accusations of the Gangbuk Police Station chief are also something that should not be spun as mutiny. If they do not take these as warnings and hurry to make fundamental changes in their understanding and make systemic reforms, they will only be ignored and rebuked by the people in a greater manner.
‘인권경시 실적주의’가 경찰 일탈 불렀다
경찰 지휘부가 과도하게 실적경쟁을 몰아붙인 탓에 양천경찰서 고문·가혹행위 사건이 벌어졌다는 현직 경찰서장의 고발이 나왔다. 검거 실적과 점수 따위만 강조되면서 경찰조직에서 국민의 인권과 안녕, 법절차 준수 등은 경시되기 일쑤라는 것이다. 지금 같은 실적주의가 고쳐지지 않는다면 또다른 가혹행위가 이어질 것이라는 경고도 있다.
과도한 실적주의의 폐해는 경찰 안팎에서 진작부터 지적돼온 일이다. 범죄별로 검거점수 따위를 정해놓고 이를 인사에 반영하겠다며 옥죄다 보면 일선 경찰 스스로 순찰 등 범죄 예방 활동이나 대민봉사 등 점수가 안 되는 일에는 소홀해지기 마련이다. 배점이 낮거나 해결이 어려운 범죄 수사엔 의욕을 보이지 않고, 손쉬운 수사에만 치중하는 일도 다반사다. 훈방조처를 해도 될 이들을 굳이 애꿎은 범죄자로 만들거나, 양천서 고문 사건과 같은 어처구니없는 일이 벌어지는 것도 그 때문이라는 것이다. 경찰이 국민을 실적 올리기의 대상으로 삼는 꼴이다.
이런 풍토가 어디서 비롯됐는지도 따져야 한다. 기자회견을 통해 문제를 제기한 채수창 서울 강북경찰서장은 서울경찰청장이 잘못된 조직문화에 책임을 지고 사퇴해야 한다고 주장했다. 그가 기존에 있던 형사성과제도를 인사에 반영하도록 하면서 과도한 실적경쟁을 부추겼다는 것이다. 하지만 성과와 효율만 앞세우는 실적주의의 뿌리는 그보다 더 깊어 보인다.
경찰 조직이 인권이나 민주적 절차 따위를 아무렇지 않게 여기게 된 것은 그렇게 해도 뒤탈은커녕 상을 받게 된다는 경험이 있었기 때문일 것이다. 실제, 이명박 정부 들어 시민을 폭도로 취급하며 폭언과 폭행을 저질렀거나 무리한 진압 등으로 국민의 생명과 인권을 위협했던 경찰 간부들은 대부분 아무런 인사조처도 없이 영전하거나 현직을 지켰다. 경찰은 또 지난해 국가인권위의 권고의견 가운데 60% 이상을 대놓고 무시했다. 이명박 대통령이 “경찰 직무집행 과정에서 사소한 잘못은 문제 삼지 않겠다”며 성과우선주의를 내세운 데서 이런 일들이 벌어졌다고 보는 것은 지나친 분석이 아니다.
정부와 경찰은 양천서 사건을 몇몇의 일탈로 외면해선 안 된다. 강북서장의 고발도 하극상 따위로 폄하할 일이 아니다. 이를 경고 삼아 근본적인 인식 전환과 제도개편을 서두르지 않는다면 국민의 더한 외면과 질타를 받게 된다.
