The ruling Grand National Party (GNP) introduced a bill yesterday that would amend the Assembly and Demonstration Law to ban nighttime outdoor assemblies from 10:00 p.m. to 6:00 a.m. This is a follow-up measure in response to the Constitutional Court decision in September ruling the law’s ban on nighttime outdoor assemblies unconstitutional and calling for the law’s revision, but it is questionable whether the bill accords with the intention of the court’s decision.
헌재 결정 취지 외면한 여당의 집시법 개정안
한나라당이 밤 10시부터 야간 옥외집회를 금지하는 내용의 ‘집회 및 시위에 관한 법률’(집시법) 개정안을 어제 국회 관련 상임위에 상정해, 처리에 나섰다. 현행 집시법의 야간 옥외집회 금지 규정에 대해 헌법재판소가 지난해 9월 헌법불합치 결정을 내린 데 따른 후속조처라지만, 개정안이 헌재의 결정 취지에 맞는지는 의문이다.
