President Lee Myung-bak reportedly is receiving the resignations of not only the heads of public corporations but also the chiefs of state-run research institutes. Lee may want his men stationed in profitable and powerful positions, but this is too much. Lee should immediately stop ousting these figures. His actions are likely to violate the law and destroy future benefits to the public good.
The directors of 305 public institutions, including state-funded companies or research institutes, have legally guaranteed terms. Under related laws, they cannot be dismissed from their posts unless they commit a serious act. Though some of the directors of the institutions have tendered their resignations in recent days, they have in fact been forced to step down. The government is the one violating the law.
President Lee’s administration says that it is necessary to re-appoint the directors because the administration has changed. Such an idea is arrogant as well as arbitrary. Public institutions provide a public service to society on behalf of central or regional governments. But their roles will not change significantly just because there has been a change of administration. If the government re-appoints the directors of public institutions whenever a new regime takes office, it will inevitably lead the institutions to neglect their duties and adhere only to the interests of the government.
Replacing the directors of research institutes is the same as forcing them to act in accordance with the wishes of the regime by abandoning their consciences as scholars. It is an act that debases those academics who have made a contribution to the development of society by voluntarily conducting independent research. Though state-run research institutes are required to support government policies to a degree, if the government only selects leaders who agree with its policies, it will be of no benefit to either the government or the research institutions themselves.
President Lee appears to think he can do anything he pleases now that he has come into power. This kind of thinking is typical for a chief executive officer. However, the management of a nation is different from that of a company. It is not only against the law to replace the heads of all public firms and research institutions with yes-men, but also distorts their duties. Hopefully Lee will immediately stop illegal actions like these and guarantee employment terms at public institutions as stated by law.
공공기관장 몰아내기 당장 중단하라
이명박 정부가 공기업 사장 등에 이어 국책연구기관장들의 사표도 받고 있다고 한다. 정권을 잡았으니 ‘돈 되고, 힘 쓰는’ 자리를 모두 자기 사람으로 채우고 싶겠지만 그 도가 너무 심하다. 이러한 ‘몰아내기’는 다분히 법률 위반 소지가 높고, 우리 사회의 공공성을 파괴하는 행위로서, 당장 중단해야 한다.
공기업이나 국책연구기관 등 305곳 공공기관의 장은 현행 ‘공공기관의 운영에 관한 법률’에 따라 임기를 보장받는다. 법령이나 정관을 위반하는 행위를 하는 등 특별한 경우를 제외하고는 임기 중 해임되지 아니한다고 규정돼 있다.(공공기관 운영법 25조5항) 기관장들이 스스로 사표를 내는 형식을 취하고 있지만 이는 사실상 강요된 것으로, 뚜렷한 사유 없이 해임하는 것이나 마찬가지다. 정부가 스스로 법을 어기고 있는 셈이다.
이 정부는 정권이 바뀌었으니 한번쯤 재신임하는 절차는 필요하다고 말하고 있다. 너무 자의적인 발상일 뿐 아니라 오만한 태도다. 공공기관이란 말 그대로 정부나 지방자치단체를 대신해 우리 사회에 공공서비스를 제공하는 기관들이다. 그런 기관의 역할이 정권이 바뀌었다고 해서 하루아침에 달라지지는 않는다. 정권이 바뀔 때마다 기관장들을 바꾸려 한다면 그 기관은 공적인 일은 팽개치고 정권의 사익에 충실하게 된다.
특히, 연구기관장들까지 교체하는 것은 연구자들에게 학자적 양심을 내던지고 정권 코드에 맞추라고 강요하는 것과 같다. 자율적이고 독립적인 연구활동을 함으로써 사회 발전에 기여해야 하는 학자들에 대한 모독이다. 정부 정책을 뒷받침해야 하는 국책연구기관의 특성상 정부와 손발을 맞춰야 할 필요가 있긴 하다. 그렇다고 노골적으로 줄세우기를 하려는 것은 정부나 연구기관 두루 전혀 득이 되지 않는다.
이러한 ‘몰아내기’의 밑바탕에는 이명박 대통령의 ‘내가 정권을 잡았느니 내 맘대로 한다’는 사고 방식이 깔려 있다. 전형적인 기업 최고경영자(CEO)식 발상이다. 하지만 국가 경영을 기업 경영 하듯이 해서는 안 된다. 모든 공기업과 연구기관 책임자를 정권 입맛에 맞는 사람으로 바꾸려는 것은 위법적일 뿐 아니라 공기업과 연구기관의 소임을 왜곡시키는 일이다. 이런 위법적인 행위를 당장 중단하고 법률이 정한 공공기관장들의 임기를 보장하길 바란다.
