The Ministry of Labor has found that 119 special medical checkup facilities violated the law or made fraudulent diagnoses, after running an check on nation's 120 designated medical facilities which provide the "special health checkup" for the workers who are or will be engaged in the harmful factors between September and December of last year. According to the ministry, many facilities often let doctors or interns who do not have professional knowledge over harmful chemicals diagnose workers who have to deal with harmful materials. Although some facilities do have doctors specializing in industrial medicine, the doctors did not come to the office for work. Even worse, other facilities did not have any specialized doctors at all. The ministry punished those facilities by canceling its authorization for special health checkup, imposing the suspensions, or ordering corrective measures in accordance with the severity of their unlawful acts.
The nation's labor problem has been like this all the time. It is not until the worst has come to the worst that people begin to take note. In fact, it has been an open secret among people that those facilities provide perfunctory medical checkup services for workers. That is why labor unions and some of medical practitioners have called for the authorities concerned to take some measures to tackle those cursory medical practices for a long time. The ministry has also revealed violations in the workplace. Some employers ordered new workers to undergo an examination for exposure to harmful materials on the first day of work. Others instructed workers who deal with hazardous materials not to work for several days before the special checkup or transferred them to other worksites in order to exclude them from the checkup. However, such cases of irregularity are not new.
As a nation makes progress in every area of society, people are becoming more concerned about health care, not just bent on making money for their living. Korea has reached that threshold. Therefore, workers are now shouting for protection of their health in the workplace, just as Chun Tae-il burned himself to death, crying out for observance of the Labor Standard Law 36 years ago. The ministry should throw the details of malpractice in those medical checkup centers open to the public to help workers protect themselves from harmful materials, and employers who often regard medical examinations as unnecessary spending should change their way of thinking. For their part, medical facilities should not see a health checkup for workers as a way to make money.
특수건강진단은 돈벌이 수단이 아니다
노동부가 지난해 9월부터 12월까지 전국 특수 건강진단 기관 120곳을 점검한 결과, 단 한 곳을 뺀 119개 기관이 법을 위반하거나 부실한 진단을 한 것으로 드러났다고 한다. 유해물질에 전문지식이 없는 일반 의사나 수련의가 유해물질 취급 사업장 노동자들의 건강진단을 한 경우가 많았고, 산업의학 담당 의사가 없거나 담당 의사가 병원에 나와 있지 않은 경우도 있었다. 노동부는 이들 진단기관에 지정취소, 업무정지, 시정조처 등을 내렸다.
노동문제는 늘 이런 식이다. 문제가 곪아터질 지경이 돼야 사람들이 주목한다. 특수 건강진단이 부실하다는 것은 많은 노동자들 사이에서는 공공연한 사실이었다. 오래 전부터 노동조합과 일부 보건의료인들은 특수 건강진단을 제대로 벌이고자 여러 조처들을 꾸준히 강조해 왔다. 유해물질 생물학적 노출지표 검사를 노동자가 사업장에 출근하자마자 행한 사례도 있었다는 것이 노동부 발표 내용이지만, 별로 새로운 일도 아니다. “특수 건강검진이 있기 며칠 전부터는 일을 시키지 않았다”거나 “위험물질을 취급하는 작업자를 건강검진 며칠 전에 부서를 이동시켜 검사 대상에서 제외했다”는 말 따위가 나온 건 어제오늘 일이 아니다.
사회가 발전해 가면, 단순히 ‘먹고 사는’ 문제를 넘어 ‘건강하게 일하며 사는’ 데 관심을 기울이는 단계에 이르게 된다. 우리는 겨우 그 문턱에 도달했다. 36년 전 전태일 열사가 “근로기준법을 지키라”고 외치며 분신한 것처럼, 지금 우리 사회에서는 “노동자 건강을 지키라”는 외침들이 나오기 시작했다. 노동부는 부실 건강진단기관 내역을 자세히 공개해 노동자들이 스스로 건강을 지킬 수 있도록 해야 하고, 기업은 건강진단을 불필요한 비용의 지출로 보는 시각을 버려야 한다. 의료기관 역시 건강진단을 돈벌이 수단으로 보는 인식에서 벗어나야 한다.
